FOREIGN EXCHANGE PURCHASE TRANSACTION AGAINST RUPIAH

For Corporate Customer

Refering to Bank Indonesia Regulation Number: 10/28/PBI/2008 regarding Foreign Exchange Purchase Transaction to Bank, hence effective as of 1st December 2008 HSBC implements the following:

1.

For every purchase of foreign currency against Rupiah by customer / foreign party with value not exceeding USD 100,000 should be accompanied with a formal declaration with stamp duty signed by the customer / foreign party or their respective authorized person, stating that such foreign exchange purchase transaction against Rupiah does not exceed USD 100,000 or its equivalent per month per customer / foreign party across all banks in Indonesia.

2.

Purchase of foreign currency against IDR by customers as contemplated in the said regulation includes spot, forward, and other type of derivative transactions, whilst by foreign party includes only spot outright (forward and other type of derivative transaction entered into by foreign party shall be subject to Bank Indonesian’s regulation on the restriction of IDR transaction and extension of foreign currency facility).

3.

For every purchase of foreign currency against Rupiah by customers / foreign party above USD 100,000 or its equivalent per month per customer / foreign party, the following documents should be submitted:

 

a.

copy of tax identity (NPWP) (NPWP does not apply for foreign party)

 

b.

copy of business lisence from the relevant authority (depending on the nature of business)

 

c.

documents evidencing the underlying transaction

 

d.

statement letter with stamp duty signed by the customer / foreign party or their respective authorized person (or authenticated document for foreign party) stating that the underlying documents are valid and will only be used to purchase foreign currency at the maximum in the same amount as the underlying transaction across all banks in Indonesia

For Personal Customer

1.

For every purchase of foreign currency against Rupiah by customer / foreign party with value not exceeding USD 100,000 should be accompanied with a formal declaration with stamp duty signed by the customer / foreign party, stating that such foreign exchange purchase transaction against Rupiah does not exceed USD 100,000 or its equivalent per month per customer / foreign party across all banks in Indonesia.

2.

copy of customer identity and copy of tax identity (NPWP) (NPWP does not apply for foreign party) - effective as of 13 November 2008.

 

b.

documents evidencing the underlying transaction – effective as of 01 December 2008.

 

c.

statement letter with stamp duty signed by the customer / foreign party (or authenticated document for foreign party) stating that the underlying documents are valid and will only be used to purchase foreign currency at the maximum in the same amount as the underlying  transaction across all banks in Indonesia - effective as of 01 December 2008.
